Will the NDIS National Disability Safeguards Commissioner be any better for consumers than the Victorian pass-the-buck, avoid and deny pseudo state government so called complaint investigation bodies?

The Victorian elongated complaints process is designed and intended to message consumers (people with disabilities and their stakeholder/s) with, “Don’t bother us!”

Consumers are required to prove their concern beyond reasonable doubt, sufficient to stand up in the supreme court. Rather than the service provider expected to value the consumer’s concerns. Using their concerns/complaints as tools to service improvement, and encouraging the consumer to evaluate the service at any time.

All pseudo state government complaint investigation bodies, except VCAT, have no teeth. They can only conciliate. However, to get to VCAT the consumer has to suffer the time consuming and stressful bureaucratic due process.

A DHHS consumer has to first take their complaint to the department’s internal complaints process. If the complaint is rejected, they go to the Disability Services Commissioner, then to the Ombudsman, and then to the Ombudsman review process before taking the matter to VCAT. If they attempt to negate the process, VCAT will ask why. As VCAT expects all avenues to have been exhausted.

Many consumers are burnt out with the frustrations of just getting to the first process that they give up and go away. Which is the intention of the process – “Don’t bother us!”

Many stakeholders are in fear of their person with disabilities being intimidated, neglected or abused if they dare to raise concerns about the support service being provided. This is especially so where their person is a resident of a group home, as this style of living is very much behind closed doors.
