‘Guardianship & Administration Act’
A new Act is on its way for Victoria
The new Guardian & Administration Bill was released late last month. Generally, Administration is no problem to get - so a brief look at just Guardianship.
The existing Act focuses on ‘need’ – “Does the person with a disability need a guardian”. Rather than – “Is the guardian suitable”.
Under the ‘need’ focus of the existing Act, it was/is almost impossible to get whole of life guardianship – ‘Plenary Guardianship’. Whereas, there were relatively few checks and balances on the guardian being a suitable person.
There appears to be an about-turn with the new Act – Far more focus on the common sense needs of the person with the disability, especially those with high support needs, and far more on the suitability of the guardian.
