A Judge has slammed a controversial" competency" test devised by the government for disabled workers, saying it has led to lower wages and is discriminatory

The federal government could be liable for a compensation bill for disabled workers, some of whom earn less than a dollar an hour working in government subsidised businesses known as Australian Disability Enterprises (ADEs), doing tasks such as filling envelopes, packing muesli bars and gardening work.

The ADEs, formerly known as sheltered workshops, assess workers using the Business Services Wage Assessment Tool (BSWAT), which measures their productivity as well as ‘‘core’’ and ‘‘industry’’ competencies.

The BSWAT assessment tool is a joke. It is discriminatory and unfair. It asks people with an intellectual disability to articulate complex concepts and marks them down if they cannot. It was defended by the CRS, the body that administers the assessment like this: "If a worker is employed to stir paint every day, he may get very good at this job,fast and efficient. But if one day, the paint spills, he is a useful employee only if he knows what to do and how to clean it up.Our assessment doesn't just test his ability to stir the paint, it tests his knowledge of what to do in an emergency." This is rubbish, because the workers in a supported workplace will always have support staff on hand to direct them in the case of an emergency.
